Governor Alfred Mutua has been ordered to be arrested by Machakos police for disobeying court orders.
On Wednesday, September 1, the Environment and Land Court in Machakos ordered Governor Mutua to be arrested for failing to pay a petitioner Ksh5.5 million.
According to the arrest notice obtained by Kenyans.co.ke, Machakos Law Courts Senior Resident Magistrate Charles Ondieki has ordered police to detain Mutua unless he pays the court’s judgment.
The court also stated that the Governor should be responsible for the expenditures of the executing officers.
“You are also required to return this warrant as soon as it is performed or the money stated in the margin is tendered to you with an endorsement certifying the day on which and manner in which it has been executed,” read part of the warrant.
Mutua was sued by businessman David Gitau Thairu for dumping garbage on his farm in Machakos.
The Governor, on the other hand, disobeyed a High Court order prohibiting him from dumping waste on the businessman’s property, resulting in the lawsuit.
The court also ordered Mutua and his administration to remove the waste that had been dumped on the property.
Thairu sought a determination that the Machakos County Government and the Governor had violated his property deprivation rights.

Thairu told the court that despite the Governor being aware of the court instructions, he failed to follow them.
The authority and dignity of this court are at risk unless this honourable court cites the Governor County Government of Machakos for disobedience of court orders,” Thairu wrote in his motion.
